DESCRIPTION
The Bharatiya Nagarik Suraksha Sanhita (BNSS) is India’s modern procedural criminal law, replacing the colonial-era Code of Criminal Procedure (CrPC). It outlines the operational mechanics of the justice system, governing how police investigate crimes, conduct arrests, manage trials, and protect the rights of victims and citizens.
The BNSS brings several major procedural changes:
- Digital FIRs: Allows citizens to file an e-FIR and mandates that the police provide a copy of the recorded complaint to the victim within three days. [1]
- Zero FIR: Empowers victims to file a First Information Report (FIR) at any police station, regardless of territorial jurisdiction.
- Mandatory Forensics: Requires forensic experts to visit crime scenes for offenses that carry a punishment of seven years or more.
- Time-Bound Justice: Sets strict timelines, including delivering court judgments within 45 days of the trial concluding and providing investigation updates to victims within 90 days.
